Tenants Terms and Conditions


We would like to provide clarity of the fees that may become payable during a tenancy you are looking to enter into. We believe you should understand these before you make any decision about a property or before you decide to view a property.

Acceptance of any offer will be subject to contract, referencing and immigration checks. You will need to pay the Rent and Deposit that is due under a Tenancy Deposit.

You will be given 2 working days to complete your application forms to the extent sufficient for us to make an initial assessment and recommendation to the landlord. Once provisionally approved, the reference checking process will commence, and a further 5 working days will be allowed for completion of the enquiries. Failure to adhere to these time limits may result in other applications being given priority and your holding deposit being forfitted.

Referencing and Right to Rent Checks
 - You will be asked to complete an application before referencing can be undertaken, all applicants over the age of 18 years will need to provide:-
A original photographic Identification (e.g. passport, National ID card, VISA, resident permit, driving licence)
Non UK Residence - Biometric Residence Permit
Non UK Residence - EU Settlement Scheme, EU settled status or EU pre-settled status - https://www.gov.uk/prove-right-to-rent
Proof of Residence (e.g. original utility bill, council tax bill or bank statement all of which much be less than 3 months old)
Proof of Income (e.g. contract of employment, 6 weekly payslips or 3 months payslips)
Bank Statement (Current Account - 3 months worth)
Student Confirmation Letter (If Applicable)
Sponsorship Letter (If Applicable)

Holding Deposit of one weeks rent and subject to satisfactory referencing will be refunded towards your first months’ rent (This is to secure the property)

Please note that the information used for the purpose of accruing references for the applicant(s)/guarantor(s). Failing a right to rent check, providing incorrect or false information, lack of supporting documentation, incorrect evidence, incomplete application forms or fail to sign your tenancy agreement (and/or deed of gurantee) within 15 calendar days (or other deadline for agreement  as mutally agreed in writing) will deem your application for failure. This will result in you forfeiting any Holding Deposit paid to Elite Property Management. In addition the holding deposit is non-refundable if you choose to no longer proceed with the application/tenancy agreement).


Guarantor(s) Documents

You should be aware that the need for a guarantor may not become apparent until your referencing (including references for any joint tenants) has been completed. Where a guarantor is required they will need to complete an application form and provideL-

Referencing will cover a check against the credit file and public records of the individual, an Anti-Money Laundering check, confirmation of employment and salary details, confirmation of previous tenancy details, right to rent checks, reporting the results of all those checks to your prospective landlord to see if your application is acceptable.
 

Scale of Charges for Tenants
Tenant Fees Act 2019 permits certain fees / charges to be made under the following circumstances:

First Months Rent

Rents are as quoted in our particulars and will generally be payable calendar monthly in advance, due in advance on the fith day of each month. If you take over part way through a month, an apportioned amount will be calculated as the rent due from the start date to the end of that calendar month although you will need to pay at least one full month of rent at commencement.

Tenant Deposit
From 1 June 2019 landlords in England are limited to the equivalent of 5 weeks rent for new and renewed tenancies (or 6 weeks if the annual rent is £50,000 or more). This is calculated by dividing the annual rent by 52 and multiplying by 5 (or 6 if rent is £50,000 or more) and will be required to be paid at the start of the tenancy. 
We normally hold this in the capacity of Stakeholder for the duration of the tenancy in our Client's Account in accordance with the UKALA Regulations and it is covered by our membership of the UKALA Client Money Protection scheme. The deposit will also be protected and handled in accordance with the rules of The Dispute Service Limited (TDS,) a government approved body under the Housing Act 2006, of which we are members. Neither party to the tenancy will be entitled to any interest on the deposit and any interest accruing will belong to the stakeholder. In some cases, the deposit will be held and protected by the landlord, in which case you will be notified.


Late Payment Charges                                     

Interest at the rate of 3% above the Bank of England's base rare for each day on any rent lawfully due that is paid more than 14 days after the date on which it becomes due. The interest will be payable from the date the rent should been paid until he rent is actually paid.

Loss of Key or Other Security Devices

Reasonable costs for any lost key(s) or security device giving access to the property or the properties outbuildings (e.g. fob, electronic device for garage doors / security gates)

Payment on variation, assignment or novation of tenancy - £50.00

When a tenant has requested it, a charge vary, assign or replace a tenancy. Fee charge £50 (including VAT).

Termination (surrender) of a Fixed term tenancy agreement - capped at the landlord's loss or the agent's reasonably incurred costs
(Subject to Landlord(s) consent)

Please note: You are legally required to pay the rent up until either a suitable tenant replacement is found or your fixed term agreement has ended.

Utilities, communication services (eg. telephone, broadband), TV licence and council tax
(if not included within rental)

Contractual damages in the event of the tenant's default of a tenancy agreement

Any other permitted payments under the Tenant Fees Act 2019
